Dear Friends,

We request you to carefully read and understand the terms and condition given below before you register yourself for any of the tours.

Definitions:
  1. Passenger means the persons/you in whose name or on whose behalf the booking is made.
  2. Company means “Guardian Holidays Pvt. Ltd.”
  3. Booking means confirmation by the passenger to travel on a specific tour by paying a non-refundable advance of Rs. 10,000/- per person for Domestic Tours and Rs. 20,000/- per person for International tours.
Legal Discretion of the company:
  1. Passengers's signature on the booking form or paying the registration amount shall mean total acceptance of the Terms & Conditions contained herein by the passengers. In case of one or more, but not all passengers signing the booking form, it shall be deemed that the others have duly authorized the concerned signing passenger. There is no contract between the Company and the client until the company has received the appropriate advance as booking amount. The full payment must be received in accordance with procedures laid down in the payment terms. If not paid in that time, the company reserves the right to cancel the booking with consequent loss of booking amount and apply cancellation charges as mentioned in this brochure.
  2. The company has full discretion to cancel the application of any of the desiring Participants without assigning any reason after acceptance of the booking amount but prior to the commencement of the tour. In the event the company terminates the contract, the company may refund the booking amount without payment of any Interest.
  3. All disputes pertaining to the tour and travel conducted by the company and any Claims arising thereby shall be subject to Pune jurisdiction only.
  4. The company shall be entitled to amend, alter, vary or withdraw any tour or Holiday facility it has advertised or published or to substitute a hotel or air journey, railway journey, bus journey or commencement of the tour or date etc. for the reason, which may be deemed fit and proper by the company and the participants shall have no rights to raise any dispute regarding the same.
  5. Any claim or complaint by the client must be notified to the company in writing within 5 working days from the end of the tour. No claim notified to the company later than this period will be considered by the Company.
  6. The company shall operate all tours with a minimum group size of 20 adult passengers in each group. If the group strength falls below 20 passengers, for Europe & USA tours 35 passengers. Company reserves the right to prepone / postpone/ merge or cancel the tour passengers:

    Option to travel on FIT basis (Free independent traveler). In such case the group will not be accompanied by a tour escort, and the Total Tour price may increase.

    Option of refund of the entire amount paid towards the tour cost till the cancellation date, in such case any NON REFUNDABLE rail or air ticket purchased by the respective passenger through the company or otherwise shall not be refundable by the company in any circumstances. However if the rail or airfare is refundable as per the railways or airlines policy the same shall apply. Any refund payable to the passenger will be refunded after receipt of the refund from respective airlines / railways after deducing the processing charges.

    Refund: Refunds, for amendments and / or cancellations will be paid directly to the passenger strictly by A/C payee cheque in Indian rupees within 72 working hours from the receipt of a written cancellation request duly signed by the passenger in whose name the booking is done. No refund will be provided for any unused portion of the tour, due to whatsoever reason.

    If the company prepones or postpones a tour due to any circumstances beyond its control like natural calamities, political unrest, change in airline schedule; the passenger will be offered the following options:

    • In case of travel on the preponed or postponed tour date, the difference amount towards the losses incurred due to the cancellation of the original tour date will be levied
    • In case the passenger is unable to travel on the postponed or preponed date the company shall levy cancellation charges of a minimum of Rs. 2000/- per head in case of Domestic tours and Rs. 10000/- per head in case of International tours or actual, whichever is higher and the balance amount will be refunded to the client within 72 hours of the cancellation date of the tour
  7. The company reserves the sole right to change the hotel, transport and sightseeing, tour Itinerary and any such components of the tour booking at any moment of time due to unavoidable circumstances.
  8. A person traveling alone has to pay single occupancy charges over and above the tour cost specified by the Company at the time of booking. If however, a single passenger desires to share the room, Guardian holidays will suggest room partner/ partners if available for the concerned tour date. In such case, he/ she have to share a double / triple room with the respective room partners on the passenger's responsibility
Liability & Loss of Property or Life:

The company shall, in no circumstances whatsoever, be liable to the client or any other person traveling for the loss of Property or Life due to the following reasons:
  1. Any change in flight schedule or meals not being served during the air journey. Expenses for the same have to be borne by the passenger.
  2. Delay or changes in train, bus, flight, ship, or other services, sickness, weather conditions, strikes, war, quarantine or any other causes beyond the control of the Company.
  3. Sightseeing missed and/ or the program being curtailed after commencement of the tour and before the due period due to any unavoidable circumstances and any reason beyond our control such as political crisis, monument under renovation, heavy rush at sightseeing places, road traffic congestion and other reasons affecting the smooth operations of the tour.
  4. Death, personal injury ,accident, sickness, delay, discomfort Health and Insurance - All passengers should obtain a Medical Insurance covering their stay abroad and Guardian Holidays will not bear any responsibility towards any costs arising out of illness, accidents etc of passengers. Guardian Holidays will not undertake the personal and financial responsibility of the passenger in any case whatsoever. Passengers will be traveling at their own risk. Any person wishing to book any of the tours offered by Guardian Holidays, MUST be present in person at the time of booking. Tour Bookings of Passengers will be totally at the discretion of Guardian Holidays and will depend on the health conditions of the concerned passenger.
